Terms of Use

These terms govern your use of the cloud10os.com website. They are not the agreement under which we supply phone systems, AI voice agents or any other service — that is a separate signed contract, and section 3 explains how the two fit together.

Effective: 1 October 2026 Last updated: 1 October 2026 Applies to: cloud10os.com

1. Accepting these terms

By accessing or using cloud10os.com (the “site”) you agree to these Terms of Use. If you do not agree with them, please do not use the site. If you are using the site on behalf of a business, you confirm that you are authorised to accept these terms for it.

2. Who we are

The site is operated by Messenger Communications Inc., doing business as Cloud10 Office Services, of 812 State Fair Blvd, Syracuse, NY 13209, United States (“Cloud10”, “we”, “us”, “our”). You can reach us on 315.314.8776 or at support@cloud10os.com.

3. The website, not the service

These terms cover this website only. The services we sell — telephone systems, AI voice agents, website chat, on-hold messaging, call queuing, answering services, equipment, installation and support — are supplied under a separate written service agreement between Cloud10 and the customer. Nothing on this site varies, replaces or adds to that agreement, and where the two differ about a service, the signed agreement governs.

Nothing on this site is an offer capable of acceptance. Booking a consultation, using the calculator or reading a service description does not create a contract for services. A contract exists only when we have both signed one.

4. How you may use the site

You may read the site, use its tools for your own business purposes, and print or save pages for your own reference. You may not:

  • copy, republish or redistribute substantial parts of the site for commercial purposes without our written permission;
  • scrape, harvest or systematically extract its content, or use it to train a machine learning model, without our written permission;
  • attempt to gain unauthorised access to the site, its hosting or any connected system;
  • interfere with the site’s operation, or introduce malicious code to it;
  • use the site in breach of any applicable law, or to send us anything unlawful.

5. Our content and marks

The text, design, layout, graphics, code and photography on this site are owned by Cloud10 or used with permission, and are protected by copyright and other intellectual property laws. “Cloud10”, “Cloud10 Office Services” and our logo are our marks.

Third-party names and marks on this site — including Wildix, Zoho and Google — belong to their respective owners and appear to identify the platforms and services we work with. Their appearance does not imply any endorsement of us by them beyond the partner status we state on the site.

6. The missed-call calculator

The missed-call calculator produces an estimate based entirely on the figures you enter. It applies straightforward arithmetic to your own assumptions about call volume, conversion and customer value. It does not know anything about your business, it is not based on an audit of your call data, and we do not verify what you type in.

Its output is an illustration for discussion. It is not a quotation, a forecast, a representation of results you will achieve, a guarantee of savings or revenue, and it is not financial advice. Do not rely on it as the sole basis for a business decision.

7. The AI demonstration

The “Hear the AI agent” demonstration, the live-call card, the transcript and the status figures shown on the homepage are scripted illustrations of how the product behaves, in the way a screenshot or a product video is. They are not a live call, not a recording of a real customer call, and not a real-time view of any system. Actual behaviour depends on how an agent is configured for a particular business.

8. Compliance statements are not advice

Where this site says that call recording, voicemail transcription or the underlying platform meets HIPAA or GDPR obligations, that describes capabilities of the platform we deploy and the way we configure it. It is a statement about technology, not legal advice, and it is not a certification of your organisation.

Compliance is a property of how you run your business, not of a product you buy. You remain responsible for your own regulatory obligations, for the policies and training around them, and for taking your own legal advice. We are glad to walk your compliance lead through the technical specifics, and we do not substitute for your counsel.

9. Call recording and notification

Call recording, voicemail transcription, call summaries and sentiment scoring are regulated. Rules differ by state and by country, they change, and they can require notifying or obtaining the consent of some or all parties on a call.

If you use recording or transcription features, you are responsible for complying with those rules, including giving any notice or obtaining any consent the law requires, for the retention and security of the recordings you hold, and for responding to requests about them from the people recorded. We will configure the system as you instruct, and we cannot determine what the law requires of your business.

10. Pricing and proposals

Any figure shown on this site is indicative and may change without notice. Prices quoted during a consultation are valid only as stated in a written proposal, are subject to survey, site conditions and the equipment and numbers actually required, and exclude taxes, regulatory charges and third-party fees unless the proposal says otherwise.

11. Reviews and customer names

Reviews and star ratings shown on this site are drawn from our public Google Business Profile and are the opinions of the people who wrote them, reproduced as published. They describe those customers’ experiences and are not a promise of the result you will get.

Customer names and logos appear with permission. If you are named here and would like that changed or removed, email support@cloud10os.com and we will act on it promptly.

12. Third-party links and services

This site links to services operated by others, including the Cloud10 Portal, booking and service request forms hosted by Zoho, an accounting portal, and hosted on-hold audio. Those services have their own terms and privacy policies, which govern your use of them. We are not responsible for the content, availability or practices of any site we link to.

13. Availability

We aim to keep the site available, and we may change, suspend or withdraw any part of it at any time without notice. We may also correct, update or remove content. Nothing here commits us to keeping any particular page, tool or figure online.

14. Disclaimer of warranties

The site and everything on it are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and any warranty that the site will be uninterrupted, timely, secure, error-free, or free of viruses or other harmful components.

We take care over what we publish, and we do not warrant that the content is complete, current or accurate. This section does not limit any warranty given in a signed service agreement, and does not exclude liability that cannot lawfully be excluded.

15. Limitation of liability

To the fullest extent permitted by law, Cloud10 and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business, goodwill, data or anticipated savings, arising out of or in connection with your use of, or inability to use, this site — whether in contract, tort, negligence, strict liability or otherwise, and whether or not we were advised of the possibility.

Our total aggregate liability arising out of or relating to this site and these terms will not exceed one hundred US dollars ($100). Liability for services we supply is governed by the signed service agreement for those services, not by this section.

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

16. Indemnification

You agree to indemnify and hold harmless Cloud10 and its officers, employees and agents from any claim, loss, liability, cost or expense (including reasonable legal fees) arising out of your breach of these terms, your misuse of the site, or your violation of any law or of the rights of a third party in connection with the site.

17. Governing law and venue

These terms, and any dispute arising out of or relating to them or to this site, are governed by the laws of the State of New York, without regard to its conflict of laws rules. You and Cloud10 agree to the exclusive jurisdiction of the state and federal courts located in Onondaga County, New York, and each waives any objection to venue there.

We make no representation that the site is appropriate or available for use outside the United States. If you use it from elsewhere, you do so on your own initiative and are responsible for compliance with your local law.

18. Changes to these terms

We may update these terms from time to time. The version on this page is the one that applies, and the “last updated” date above shows when it changed. Continuing to use the site after a change means you accept the updated terms.

19. General

If any provision of these terms is held unenforceable, the rest remain in force and that provision is applied to the maximum extent permitted. Our failure to enforce a provision is not a waiver of it. These terms, together with our Privacy Policy, are the entire agreement between you and us about the site, and they do not give rights to anyone who is not a party to them.
